    The exhibitor agrees to rent from the Maryland Building Industry Association an exhibit booth for Builder Mart 2021 scheduled for October 25, 2023 at the Howard County Fairgrounds subject to the following terms and conditions. 1. Each exhibit booth (10' x 10’) includes: 8’ high draped back wall and 3’ high draped side walls, a 7” x 44” exhibitor identification sign, 500 watts of electricity and (1) 6’ draped table. The booth rental fee includes two complimentary show passes per booth. Additional passes for booth workers may be purchased at the special $35 exhibitor rate. 2. The Exhibitor agrees to arrange their display as not to obstruct the general view or block other exhibits and to confine the display within the dimensions of the booth area as marked on the exhibit floor. 8’ sidewalls are permitted only for the back half of the booth (5’ depth) of the booth, with sidewalls in the front half of the booth (5’ depth) of the booth not to exceed 4’ in height. 3. Carpeting/Flooring of all booths is mandatory. Exhibitors may opt to provide their own or rent from the show decorator. On show day, any uncarpeted booths will be carpeted on MBIA’s directive, and at exhibitor’s expense. 4. Full payment must be submitted to the Maryland Building Industry Association by September 30, 2023. If space is contracted prior to that a $500 deposit is required for each 10 X 10 booth. If full payment is not received prior to the show on October 25, 2023 a $250 penalty per booth per month will be applied.. 5. NO CANCELLATIONS. In the event of any breach of this Agreement by Exhibitor, Maryland Building Industry Association reserves the right to immediately terminate this Agreement, remove the Exhibitor from Builder Mart, and Exhibitor shall forfeit all fees paid to Maryland Building Industry Association. 6. Exhibitor must be a current member of the Maryland Building Industry Association and be in good standing with the association at the time of the show to receive member pricing. 7. The Exhibitor shall not assign or sublet any part of the contracted space without the written approval of Builder Mart Management. 8. Exhibitor will indemnify and hold harmless the Maryland Building Industry Association, Inc. from all claims and demands (be it personal injury, theft, property damage or otherwise) made by spectator or other person, for any cause, in any way arising out of the Exhibitor’s use of the building or grounds rented by the Exhibitor. For purposes of these indemnification provisions, the term “Maryland Building Industry Association” shall also include the officers, directors, employees, agents, members and representatives of Maryland Building Industry Association. Exhibitor assumes full responsibility and liability for the actions of its employees, officers, directors, invitees, servants, agents and representatives, whether acting within or without the scope of their authority. 9. The Exhibitor must maintain a policy or policies of insurance issued by an insurance company licensed to do business in Maryland. The policy or policies will insure Exhibitor as their interest may appear, against any such claims or demands for injury or damage to person or property with coverage in amounts not less than $1 million for any on injury, $1 million for any occurrence and $1 million for property damage. Maryland Building Industry Association and the Maryland State Fairgrounds shall be named as additional insureds on such policies. Exhibitors shall provide Maryland Building Industry Association with a certificate of insurance evidencing the existence and amounts of all such insurance upon request. 10. Exhibitor agrees to assume full responsibility for direct loss or damage to their own materials, supplies and other materials. ls which they own, lease, rent or which are legally liable. Valuable materials are the sole responsibility of the Exhibitors and shall be secured by the exhibitor during set up, show day and tear down. 11. Exhibitor waives the rights of subrogation against the Maryland Building Industry Association, Inc. for all liability on damages as are reflected herein. 12. The Exhibitor agrees to have their display set by 9 AM on October 21, 2021 unless special move in request submitted. NOTE: If Exhibitor plans to set up the morning of the show, a Special request must be made with MBIA. 13. The Exhibitor agrees to dismantle the display on October 22, 2021 by 11:00am. MBIA will not be responsible for materials or bills of lading remaining on the premises after 12 PM. It is the responsibility of the Exhibitor to insure the security of the booth during the move out. At the close of the show on October 21, 2021 the building will be closed and secured. Removal of hand carried items will be permitted only with submission of the Same Day Move- Out Request Form. 14. Electrical service will be proved to booths (one 500 watt receptacle per booth All exhibitors must have a 50’ 3 wire UL-approved extension cord to reach receptacle and power strip. Additional service can be secured from electrician at exhibitor expense. The Maryland State Fair, MBIA or the electrician will not be responsible for power failures or voltage fluctuations. No fuel-powered generators are permitted in the show facility. 15. The Exhibitor agrees to comply with all decisions set forth by the fire, electrical or building inspectors or any other official with jurisdiction over the show. 16. The Exhibitor agrees to staff their display during the show hours on October 21, 2021. 17. Objectionable sound making devices, including any type of amplification device, loud games or other distracting devices, are prohibited from use during the show. The committee reserves the right to remove any device that they find distracting to the show, exhibitors or attendees. 18. All Exhibitor demonstrations and activity must be conducted within the confines of the booth space. The service of food and non-alcoholic beverages is permitted by exhibitors in their assigned booth space. 19. Management reserves the right to reject any exhibit which it deems inappropriate or objectionable. 20. Gambling of any type that involves the exchange of money is prohibited during the show. 21. The Builder Mart Committee reserves the right for final approval of the floor plan up to the day of the show. 22. The Builder Mart Committee reserves the right to approve exceptions to any show rule, should they determine that it is in the best interest of the show. 23. If conditions beyond the Maryland Building Industry Association’s control compel a change in show dates or cancellation of the show, the Association shall in no event be liable in damages to the Exhibitor. 24. By signing the acceptance on the previous page, Exhibitor acknowledges that the Agreement, when executed by Exhibitor below, constitutes a binding legal agreement enforceable against Exhibitor in accordance with the terms herein. Any and all matters or questions not specifically covered in this agreement shall be subject to the decision of show management. No amendment of this agreement shall be valid, unless in writing and signed by the parties to be bound. Exhibitor and the Maryland Building Industry Association agree that this Agreement shall be governed by the laws of the State of Maryland and hereby consent to the jurisdiction of the Circuit Court for Howard County, Maryland, with respect to any dispute arising under this Agreement.
